On a two lane two-way road, passing another vehicle on the right is legal only if?

(a) the vehicle you want to pass is driving less than the posted speed limit.
(b) the vehicle ahead is signaling for a left turn and you don't have to leave the pavement.
(c) the vehicle in front of you is signaling for a right turn.
which one is it?
