Car Repossesed Due To Fraud? Is This Legally Possible?
i was involved in an accident when i was 17 and i (well my mom received insurance money for the car) the car was mine, you know like a 16th birthday gift. anyways, i picked out another car and was so in love with it. at the time we got the new car i was 17 and couldn't get a car in my name so it was financed through my mom and my uncle made the payments. anyways long story short my mother and i had a big falling out over my daughter's father, and she got mad at me and called the finance company and told them a whole bunch of stuff, i still don't know exactly what was said, but two days prior to the car getting repossed my uncle gave the company $900 which is four months of car payments in advance. The repo men came and took the car and said they'd bring it back once the finance company owner notified them. a few days later my uncle and i called to see if the car would be returned and the finance comp. owner said it was "Financial Fraud" because i had the car, but it was MY car.....
it was just in my mom's name? does the finance company have the right to take the payments and still repossess the car? i would like for them to either bring the car back or give my uncle back his money.
thye can still take the car even though they were aware of the fact that the payments were coming from my uncle? it was and still is a big mess. i know the company wasn't hesitant to take my uncle's money though!
