I bought a used car but not from the Registered Owner?

Hello I bought a used car and the TITLE owner wasn't even there in the first place! Some other person signed there name on the Pink slip and then we were off! The next day I take it in to get smogged! AND IF FAILS! He told me it would pass smog! He also convinced me to put less than I payed on the title! Was he even allowed to sign there name in the first place? Also the DMV says to take them to court for smog fee's! I have proof that I payed more than what was put down on TEXT MESSAGES when I was asking for a refund we said the amount back and forth so is that good enough proof to get a refund of my money since the owner wasn't even there and the car wouldn't pass smog?
